Obligation to submit work environment risk analysis

If your company has at least one employee, it is necessary to submit a work environment risk analysis to the Labor Inspectorate (Estonia) by 1 September 2021.

According to the Occupational Health and Safety Act (OHS), the employer must prepare a risk analysis of the work environment. This is mandatory for employers (excluding security authorities) with at least one employee. The obligation to submit a risk analysis to the Labor Inspectorate arises from an amendment to the law that entered into force this spring. There are two ways to submit a risk analysis electronically:

  1. upload the already prepared risk analysis to the Labor Inspectorate self-service portal at https://iseteenindus.ti.ee
  2. if the company does not have a risk analysis, it can be prepared directly on the self-service portal of the Labor Inspectorate https://iseteenindus.ti.ee

According to the Language Act in force in the Republic of Estonia, the risk analysis must be prepared in Estonian or in other cases it needs to be translated into Estonian.

The Labor Inspectorate will start monitoring companies, which have failed to submit the risk analysis by the set deadline. During the monitoring procedure, the non-compliant companies are reminded once again about this obligation. However, if companies still fail to comply with this requirement, they risk with receiving a penalty claim.
